Terms of Service

These terms apply to all purchases and the use of santapixy.com (“SantaPixy”) (“we”). By creating an account or buying credits you accept them.

1. The service

SantaPixy creates short, personalized videos with artificial intelligence (AI): you choose a template, enter a first name or your own message, and our system generates a video of the character speaking it. The videos are AI-generated and are clearly fictional; voices, pronunciation and movements may vary from the preview and from video to video.

2. Account

You need an account (sign-in with an email code) to buy credits and create videos. You must be at least 18 years old. Keep access to your email account secure — anyone who can read your email can sign in.

3. Credits and prices

• Videos are paid with prepaid credits. 1 credit = 1 video, with a name or your own message. There is no subscription.
• Prices are shown on the website before you buy. For customers in Europe prices are in EUR and include VAT; elsewhere prices are in USD, and applicable taxes are added at checkout.
• Payment is made through Stripe (card, Apple Pay, Google Pay and other methods offered there). Credits are added to your account as soon as the payment is confirmed.
• Credits are valid for 3 years from purchase, are personal and cannot be exchanged for cash, except as described in section 5.
• Promotion codes can only be used as stated in the offer and may be limited in number and time.

4. Creating videos

A credit is used when a video is started. Videos are usually ready within a few minutes; we’ll email you when yours is ready. If we cannot create a video, the credit is returned to your account automatically. Finished videos are available in your account for 90 days — please download videos you want to keep.

5. Right of withdrawal (consumers in the EU)

As a consumer you generally have a 14-day right of withdrawal for contracts concluded online. Because our service is digital and starts immediately, the following applies: before paying, you expressly request that we start immediately and acknowledge that your right of withdrawal expires for each credit as soon as it has been used to create a video (§ 18(1)(11) FAGG / Art. 16(m) Directive 2011/83/EU).

Unused credits: within 14 days of a purchase you can withdraw for the credits of that purchase that you have not used, and we refund their proportional value. Just write to [email protected] (for example: “I withdraw from my purchase of [date]”). Refunds are made via the original payment method within 14 days.

6. What you may not do

You are responsible for the names and messages you enter. In particular you may not:

• create content that is offensive, sexual, hateful, violent, threatening, discriminating or harassing;
• use the service to insult, bully, deceive or impersonate others, or for advertising and spam;
• enter personal data of others beyond a first name or nickname, or confidential information;
• infringe the rights of others (e.g. trademarks or copyrights);
• circumvent our safety checks, attack the service or use it automatically (bots, scraping).

Custom messages are checked automatically before a credit is used; we may reject messages without giving reasons. We may remove videos and block accounts that violate these terms. In that case unused credits are refunded, unless the violation was serious or intentional.

7. Rights to the videos

You may use, download and share the videos you create for private, non-commercial purposes (e.g. sending them to family and friends or posting them on your personal social-media profiles). Commercial use (e.g. in advertising) requires our written consent. Templates, characters and the website remain our property. Please tell recipients that the video was created with AI if they could otherwise be misled.

8. Availability and changes

We work hard to keep SantaPixy available, but cannot guarantee uninterrupted operation, especially during maintenance or outages at our providers. We may change, add or remove templates and features; this does not affect credits you have already bought.

9. Liability

We are liable without limitation for intent and gross negligence and for personal injury. For slight negligence we are liable only for breaches of essential contractual obligations, limited to the foreseeable, typical damage; liability for slight negligence is otherwise excluded. Mandatory consumer protection rights (in particular warranty under the Austrian Consumer Protection Act, KSchG, and the Consumer Warranty Act, VGG) remain unaffected.

10. Ending your account

You can delete your account at any time in “My videos”. Unused credits expire on deletion; if you have unused credits from a purchase made within the last 14 days, write to us first (see section 5). We may terminate accounts for good cause, in particular for serious violations of section 6.

11. Changes to these terms

We may update these terms for valid reasons (e.g. new features or legal changes). We will inform you by email at least 30 days before changes that affect you; if you don’t object, the new terms apply. Purchases already made remain under the terms that applied when you bought.

12. Applicable law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory laws of your country of residence. For consumers, the courts at their place of residence have jurisdiction; otherwise the competent courts in Austria.
